At a Glance​

  • Who we are: Gather Voices, Inc. ("GV") provides a platform where organizations (our Customers) invite their communities to create and share videos.

  • Who controls your data: Our Customers act as the data controller. GV is a data processor, safeguarding data on their behalf.

  • Where data is stored: By default, data is stored in AWS U.S. data centers. For Customers who require local residency (e.g., EU), we offer custom hosting under a separate agreement.

  • AI features: By default, the Service includes AI-enabled features (summarization, captions, background removal, sound processing). Customers may request these features be disabled for their account.

  • Third-party vendors: We rely on trusted partners (e.g., AWS, OpenAI, Canva, Twilio, Zoom, Google Analytics, HubSpot, etc.) to power parts of our Service.

  • Your rights: Depending on where you live, you may have rights to access, correct, delete, or limit use of your data. We help our Customers honor these rights.

  • Aggregate data: We may create and use aggregate or de-identified data for research, analytics, and business purposes, which may be shared or sold, but it will never identify individuals.

 


 

Welcome

Gather Voices, Inc. (“GV,” “we,” “us,” or “our”) provides a platform that enables our Customers (organizations) to invite their members, employees, attendees, or other participants (“End Users”) to create and upload videos and related content (“User Content”). Customers contract directly with GV, and End Users participate at the request of those Customers. This Privacy Policy explains how GV collects, uses, and protects information.

 


 

Consent to Privacy Practices

By accessing or using our platform, or by providing information to us, you consent to the practices described in this Privacy Policy. If you do not agree, please discontinue use of the Service.

 


 

Personal Data We Collect

Personal Data means information that identifies or relates to an identifiable individual, as defined under applicable law (GDPR, CPRA, etc.). We may collect:

  • Directly from you: Name, email, organization, contact information, and any content you submit.

  • From our Customers: End User information provided to enable your access.

  • Automatically: Cookies, device information, IP address, usage data, and analytics.

  • Third-party logins: If you use Google or Facebook to log in, we receive limited profile information as permitted by those providers.

  • User Content: Videos and other content you submit at a Customer’s request may contain Personal Data.

GV acts primarily as a processor on behalf of our Customers, who act as controllers of End User data.

 


 

How We Use Personal Data

We use Personal Data to:

  • Provide and operate the Service.

  • Support Customers and End Users.

  • Improve, secure, and personalize the Service.

  • Communicate with Customers (e.g., billing, support, updates).

  • Send optional marketing (with opt-out).

  • Provide AI-enabled features (captions, summaries, background removal, etc.). These are on by default but may be disabled at the Customer’s request.

  • Generate aggregate, de-identified insights (e.g., trends about event locations). GV may sell or share aggregated, anonymized data, but we will never sell Personal Data or User Content.

 


 

International Data Transfers

  • By default, all data is hosted in AWS U.S. data centers.

  • Customers may contract for alternative hosting (e.g., EU) under a separate agreement and fee.

  • For EU/UK residents, we rely on Standard Contractual Clauses or other approved safeguards for international transfers.

  • Data subjects in the EU/UK have additional rights as described below.

 


 

Information Sharing

We may share Personal Data only as follows:

  • With Subprocessors: Trusted vendors that support our operations (see Subprocessor List, available to Customers on request).

  • With affiliates or service providers: For support, analytics, communications, and infrastructure.

  • As required by law: In response to subpoenas, court orders, or legal processes.

  • For safety and fraud prevention: To protect GV, our Customers, and users.

  • Business transfers: In connection with mergers, acquisitions, or sale of assets. We do not sell Personal Data.

 


 

Your Choices & Rights

  • Marketing: You may opt out of marketing emails via unsubscribe links or by contacting us.

  • Cookies: You may control or disable cookies through your browser. Essential cookies are required for the Service.

  • Rights under GDPR/UK GDPR: Access, rectification, erasure, restriction, portability, and objection.

  • Rights under CPRA (California): Right to know, delete, correct, opt out of sale/sharing (we do not sell Personal Data), and non-discrimination.

  • To exercise rights, contact us at privacy@gathervoices.co. We may refer requests to the relevant Customer (controller).

 


 

Data Retention

  • We retain Personal Data for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements.

  • For User Content, GV retains data according to Customer instructions. Customers control deletion of End User data.

 


 

Security

GV uses industry-standard safeguards, including encryption in transit and at rest, firewalls, and monitoring systems. While no system is completely secure, we continually review and update our practices.

 


 

Children’s Privacy

  • GV does not knowingly permit children under 13 in the U.S. (or under 16 in the EU) to use the Service without verified parental consent.

  • Customers are responsible for obtaining appropriate parental consents when inviting minors.

  • If we learn we have collected data from a child without proper consent, we will delete it promptly.

 


 

Linked Sites

Our Service may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites. Please review their privacy policies.

 


 

Changes to this Policy

These Terms of Service (the “Terms” or “Agreement”) govern access to and use of the Gather Voices platform and related services (the “Service”). By signing an Order Form, accessing, or using the Service, you (“Customer” or “End User”) agree to these Terms.


Gather Voices Terms of Service / End User License Agreement

At a Glance

  • Who this covers: This document acts as both our Terms of Service (for Customers) and our End User License Agreement (for End Users). Customers contract with GV directly; End Users agree to a license when they use the Service at the invitation of a Customer.

  • Who we contract with: Our Customers are organizations. End Users participate through those Customers.

  • What you get: Video capture, editing, storage, and sharing tools, plus AI features (enabled by default, but can be turned off at the Customer’s request).

  • Where data lives: U.S. AWS data centers by default, with optional EU hosting under special contract.

  • Who owns what: Customers and End Users own their content. Gather Voices owns the platform.

  • Your responsibilities: Customers manage End User invitations, consent, and compliance with the law.

  • Our responsibilities: Gather Voices safeguards data, manages hosting, and works with trusted subprocessors.

  • Limits: We provide the Service “as is” with liability limited to fees paid in the last 12 months.

 


 

1. Parties and Scope

  • Gather Voices, Inc. ("GV") provides the Service.

  • Customers are organizations that purchase and manage access to the Service. Customers enter into a binding commercial agreement with GV through an Order Form or similar contract.

  • End Users are individuals invited by Customers to create or interact with videos. End Users are not direct contracting parties with GV but, by accessing or using the Service, they are granted a limited license (an End User License Agreement) and agree to follow these Terms.

This Agreement therefore serves both as the Terms of Service governing GV’s relationship with Customers and as the End User License Agreement governing the use of the Service by End Users.

 


 

2. Eligibility

  • The Service is not directed to children under 13 in the U.S. (or under 16 in the EU) without verified parental consent.

  • By using the Service, you confirm you are of legal age in your jurisdiction or have parental consent.

 


 

3. Customer Responsibilities

  • Customers are responsible for:

    • Inviting End Users and obtaining any necessary consents (including parental consent for minors).

    • Ensuring End Users comply with these Terms and applicable laws.

    • Determining data collection, retention, and deletion policies as the data controller.

    • Protecting access credentials and ensuring they are not shared improperly.

 


 

4. Gather Voices Responsibilities

  • GV provides hosting, support, and security for the Service.

  • GV acts as a data processor on behalf of Customers.

  • GV may process data using trusted Subprocessors. A detailed Subprocessor List is maintained by GV and is available to Customers upon request. This list may be updated from time to time, with notice to Customers where required by law or agreement.

 


 

5. Service Features

  • Core Functionality: video capture, storage, editing, and sharing.

  • AI Features: summarization, captions, background removal, and similar tools are enabled by default. Customers may request that AI features be disabled for their accounts.

  • Data Residency: By default, all data is hosted in U.S. data centers. Customers may contract for alternative hosting (e.g., EU) under a separate agreement and fee.

 


 

6. User Content

  • Customers and End Users retain ownership of all videos and content uploaded.

  • By submitting content, End Users grant GV and the Customer a license to host, process, edit, display, and distribute that content for the purposes of the Service.

  • End Users waive any “moral rights” to the extent permitted by law and acknowledge they will not receive compensation for use of their content.

  • GV does not routinely review or monitor User Content but may remove or restrict content that violates these Terms.

 


 

7. Acceptable Use

You may not use the Service to:

  • Violate any law or third-party right.

  • Upload unlawful, defamatory, obscene, or infringing content.

  • Promote violence, terrorism, hate speech, or harassment.

  • Upload malware, spam, phishing content, or impersonate others.

  • Attempt to disrupt, hack, or reverse engineer the Service.
     

GV may suspend or terminate access immediately if these rules are violated.

 


 

8. Suspension and Termination

  • GV may suspend or terminate access if necessary to protect the Service, comply with law, prevent harm, or address violations.

  • Either party may terminate for material breach if not cured within 30 days.

  • Upon termination, Customer data will be returned or deleted according to the Privacy Policy.

 


 

9. Intellectual Property

  • Customer Content: Owned by Customers/End Users, licensed to GV for service delivery.
    GV IP: GV retains ownership of the Service, software, and associated intellectual property.

  • Feedback: If you provide feedback or suggestions, GV may use them freely without obligation.

 


 

10. Payment and Subscription

  • Fees and payment terms are set out in the Order Form.

  • Subscriptions renew automatically unless otherwise agreed.

 


 

11. Confidentiality

  • Both parties agree to protect each other’s confidential information.

  • GV does not accept responsibility for receiving End User confidential information except as required to provide the Service.

  • Injunctive relief may be sought for breaches of confidentiality.

 


 

12. Indemnification

  • By GV: GV will indemnify and defend Customers against third-party claims that the Service infringes intellectual property rights, provided Customers promptly notify GV and allow GV to control the defense.

  • By Customer: Customers will indemnify and defend GV against claims arising from Customer Content, End User activities, or misuse of the Service.

 


 

13. Service Availability and Modifications

  • GV aims to keep the Service available but does not guarantee uninterrupted uptime unless otherwise specified in an SLA.

  • GV may update or modify the Service at any time. Material changes to these Terms will be communicated to Customers.

 


 

14. Export Controls and Compliance

Customers and End Users may not use the Service in violation of U.S. export laws or applicable sanctions regulations.

 


 

15. Assignment

Neither party may assign this Agreement without the other’s consent, except that either party may assign in connection with a merger, acquisition, or sale of substantially all assets.

 


 

16. Legal Stuff

  • Entire Agreement: This Agreement, together with the Order Form and Privacy Policy, is the entire agreement between the parties.

  • Severability: If any part of this Agreement is held invalid, the remainder remains enforceable.

  • Waiver: Failure to enforce any provision does not constitute a waiver.

  • Force Majeure: Neither party is liable for events beyond their reasonable control.

  • Relationship: This Agreement does not create a partnership, joint venture, or employment relationship.

 


 

17. Disclaimers and Limitation of Liability

  • The Service is provided “as is.” GV disclaims all warranties not expressly stated.

  • GV’s total liability is limited to the fees paid by Customer in the 12 months prior to the claim.

  • GV is not liable for indirect, consequential, or punitive damages.

 


 

18. Legal Disclosures

GV may disclose data when required by law, to protect safety, or in connection with a merger or acquisition.

 


 

19. Governing Law

This Agreement is governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws rules.

 


 

20. Relationship to Privacy Policy

Use of the Service is also subject to GV’s Privacy Policy, which explains how we collect, use, and protect personal data. Customers and End Users should review the Privacy Policy for details.

of, or participation in our service and product offerings, including, but

may not be able to provide you with certain aspects of our services or
products.

• Member Background Information: We will collect background
information that you provide to us, including, but not limited to, your
date of birth, ethnicity, gender, biography, primary job role, job
functions, job history, education, professional memberships, areas of
interest, social media handles, honors and awards. You will be asked
to consent to the collection of certain of this information, such as
ethnicity, in accordance with this privacy policy at the time of collection,
and you may withdraw that consent at any time. Such information is
collected to analyze member background and improve the member
experience.

• Payment Information: If you choose to purchase a product or service,
we and/or our third-party payment processors will collect your payment
information, including, but not limited to, your credit or debit card
number, card verification value (CVV) number, and expiration date.

• Enrollment, Registration, and Order Form Information: In order to enroll
in or register for an Association Forum program, attend Association
Forum events, meetings, or conferences, or request Association
Forum products or services, you will be required to fill out a registration
or order form and provide personal information, which we will use to
process your registration or order. In certain circumstances, a program,
event, meeting, or conference accessed through the Site may be jointly
sponsored or co-sponsored with another organization. If the enrollment
or registration is handled by such other organization, that
organization’s (not Association Forum’s) privacy policy will apply and
be controlling. Please note that Association Forum is not responsible

for the privacy policies of such other organizations or their collection,
use, sharing, or other processing of your personal or other information,
and Association Forum hereby disclaims any liability or responsibility in
connection therewith.

Information Collected Automatically

• Automated Information: Your web browser or mobile device
automatically provides information when you visit the Site, including,
but not limited to, your Internet Protocol (IP) address or unique device
identifier.

• Cookies: Cookies are pieces of stored information on a user’s
computer or device that are tied to information about the user and used
to provide smoother navigation throughout the Site, such as to store a
saved password; to identify user trends, such as page views; and for
other internal purposes, such as to assess the effectiveness of the
Site. You have the option of setting your computer to disable cookies

The Site and our services and products are not directed toward children

Association Forum uses the information that we collect to provide our
services and products and to operate our business. We may use and store

interests, and improve the member and prospective member

specific business transaction on behalf of Association Forum. Such

• Your name and contact information, as provided to Association Forum,
may be shared with Association Forum members to provide a service,
satisfy a question, or develop a prospective business relationship. We
are not responsible for members’ use or misuse of your personal
information.

• Your name and contact information, as provided to Association Forum,
may appear on registration or attendee lists distributed at Association
Forum programs, events, meetings, and conferences to other
attendees, including members, and other third parties, including, but
not limited to, exhibitors or sponsors. We are not responsible for use or
misuse of your personal information by exhibitors, sponsors, or the
like.

• We may share your personal information with third-parties that provide
services to Association Forum including, but not limited to,
administration/operation support; marketing, promotions, and
communications; program, event, meeting, or conference enrollment,
registration, planning, hosting, or management; website hosting;
database management; payment card processing; or other data
processing.

• We also may disclose personal information if we become subject to a
subpoena, court order, or law enforcement or other government
agency inquiry or investigation or if we are otherwise legally required to
disclose such information. We also may use and disclose information
about you to establish or exercise our legal rights, to enforce
the Terms and Conditions of Use Agreement, to assert and defend
against legal claims, or if we believe such disclosure is necessary to

• If all or part of Association Forum is merged into or otherwise
transferred to another entity, we may transfer the personal information
you provided to us to such entity as part of that transaction.

Association Forum takes your privacy and the protection of your personal
information seriously, and we will provide you with reasonable access to and
control of the personal information that you have provided to us. You may

request to update your personal information or to opt in to or opt out of any
service offerings at any time.

additional rights concerning your personal data, such as to access, obtain a

Data Security

measures to safeguard your personal information and to help protect against

payment card information, will be secured using a commercially accepted
method of encryption. However, please be aware that no method of
electronic transmission is completely infallible, and we cannot guarantee its
absolute safety. We encourage you to use reasonable care in how you

Data Retention
Association Forum retains your personal information for as long as
necessary to fulfill the purposes for which it was collected as set forth in this
privacy policy, after which we will securely destroy or delete such personal

disputes, enforce agreements, and as otherwise set forth in this privacy

website (Site). This website is provided as a service of the Association
Forum.

8. Choice of Law and Forum. This Agreement is entered into and
performed in the State of Illinois, United States of America, and is
governed by the laws of Illinois, exclusive of its choice of law or conflict
of laws provisions. In any claim or action directly or indirectly arising
under this Agreement or related to the Site, each party irrevocably
submits to the exclusive personal jurisdiction of the state courts
located in Cook County, Illinois, or the United States District Court for
the Northern District of Illinois, whichever has jurisdiction, and each
party waives any jurisdictional, venue, or inconvenient forum objections
to such court.
9. Complete Agreement. If any provision or provisions of this Agreement
are held by a court or other tribunal of competent jurisdiction not to be
enforceable, then such provisions shall be limited or eliminated to the
minimum extent necessary so that this Agreement shall otherwise
remain in full force and effect. These Terms of Use supersede any
other statements included elsewhere on the Site that are inconsistent
or conflict with these Terms of Use.

determines from time to time in the best interests of the Association
